World Sea Explorers AS is referred to in these terms as “WSE”, “we”, “us” or “our”.

2. Scope of these terms

These terms govern your use of stellaoceana.com and any enquiry submitted through the website.

They do not, by themselves, constitute the complete contract for a charter, cruise, support-vessel assignment, activity or other service.

Confirmed services are governed by the written quotation, booking confirmation, charter agreement, support-services agreement, purchase order accepted by WSE, or other contract supplied for the particular assignment.

If there is a conflict, the signed or expressly accepted service agreement takes precedence over these website terms, subject to any mandatory rights under applicable law.

3. Website information

We aim to keep the website accurate and current. However, vessel specifications, equipment, crew, rates, availability, home port, operating areas, certificates, insurance and service capabilities may change.

Information published on the website is general information and is not a binding offer or operational confirmation.

Current vessel availability, certification, passenger capacity, operating area and suitability for a particular mission must be confirmed by WSE in writing.

Website content must not be relied upon as navigational, meteorological, medical, legal, regulatory or safety advice.

4. Enquiries are not confirmed bookings

Submitting an enquiry form, sending an email, calling us or requesting a proposal does not reserve the vessel and does not require either party to proceed.

Dates and vessel capacity are only held when WSE confirms the hold in writing and any applicable option fee, deposit, credit approval or other stated requirement has been satisfied.

A booking or support assignment is confirmed only when:

the scope and commercial terms have been agreed in writing;
the required agreement, quotation or purchase order has been accepted;
WSE has issued written confirmation; and
any required deposit, option fee or third-party cost commitment has been received.

Response-time statements on the website are service targets and not contractual guarantees.

5. Private charters and guest experiences

Private charters, short cruises, expeditions and guest experiences are supplied by World Sea Explorers AS.

These services are governed by the World Sea Explorers booking terms applicable when the booking is confirmed, together with the booking confirmation and any charter-specific agreement.

Submitting an initial charter enquiry is free and does not create a booking. If a substantial amount of bespoke itinerary research is required, WSE may propose a planning or design fee before commencing that work. Any such fee, its scope and whether it is credited toward the final charter price will be disclosed and agreed in writing in advance.

6. Superyacht support services

Superyacht support services are supplied only following an operational, legal, insurance and commercial review.

Each quotation will identify the agreed service scope, operating area, dates, rates, readiness obligations, exclusions, third-party services and required documentation.

Possible services include vessel support, transfers, specialist accommodation, provisioning, non-dangerous spares, remote staging, destination activities through qualified partners, land and air coordination through licensed providers, reconnaissance and itinerary-contingency planning.

Unless separately agreed, legally authorized, procedurally approved and insured, our services do not include:

yacht or port agency;
customs, immigration or importer-of-record services;
pilotage;
search and rescue or medical evacuation;
salvage or towing;
dangerous goods or undeclared high-value cargo;
heavy lifting or crane operations;
aircraft or helicopter operation;
armed security;
custody or transport of firearms or ammunition; or
guarantees of wildlife sightings, hunting or fishing results, weather or uninterrupted itineraries.

Detailed support-services terms will be supplied with the relevant quotation or service agreement.

7. Relationship with the yacht’s agent

WSE is not a yacht agent.

Port clearance, customs, immigration, pilotage, berth reservations, statutory reporting and other agency functions remain the responsibility of the yacht and its nominated agent unless a separate properly authorized provider is contracted for those services.

We may work directly with the yacht’s nominated agent and other approved parties to deliver the agreed support scope.

An introduction, recommendation or coordination service does not mean that WSE has assumed the legal role of yacht agent, aviation operator, hunting outfitter, medical provider or another regulated service provider.

8. Safety and the master’s authority

The master of Stella Oceana has final authority over the vessel’s departure, route, speed, navigation, boarding, transfers, tender use, continuation and return.

The master may delay, modify, refuse or stop an operation where the master considers this necessary for safety, certification, insurance, safe manning, crew welfare, weather, sea conditions or legal compliance.

A licensed third-party operator has final authority over the safety and operation of its own aircraft, vehicle, activity, facility or equipment.

A customer may request a more conservative decision or cancel an operation, but may not require WSE, the master or a third-party operator to proceed after a safety or legal no-go decision.

The financial consequences of delay, cancellation, standby or a no-go decision will be determined by the applicable charter agreement, support-services agreement or quotation.

9. Third-party services

Some charters and support assignments involve independent third-party suppliers, including transport companies, aircraft operators, accommodation providers, guides, activity providers, landowners and specialist suppliers.

The quotation or booking confirmation will identify material third-party services where reasonably practicable.

Third-party services may be subject to the supplier’s own availability, operating limits, permit requirements, cancellation terms and liability conditions. Non-refundable third-party costs may become payable when WSE commits those costs with the customer’s approval.

Nothing in these terms limits any responsibility that WSE has under mandatory applicable law.

10. Prices, taxes and payment

Consumer prices will be presented inclusive of applicable taxes and mandatory charges where required by law. Optional services and variable third-party costs will be identified separately.

Business quotations will state whether prices are exclusive or inclusive of VAT and will identify known reimbursable costs, third-party costs, deposits, option fees and standby charges.

Published prices are subject to confirmation and may change before a booking or assignment is confirmed.

Payment, deposit, cancellation, option and standby conditions are governed by the applicable written quotation or agreement.

11. Information submitted to us

You must provide accurate and complete information when submitting an enquiry.

If you provide information concerning another person, you confirm that you are authorized to provide it and have informed that person about the relevant processing of their information.

Do not submit unlawful material, malicious files, unnecessary health information, payment-card information or confidential yacht documentation through a general website form.

Sensitive operational documents should only be submitted through a secure channel approved by WSE.

Submitting information through the website does not create a confidentiality or non-disclosure agreement. If an NDA is required, it must be agreed separately in writing.

Personal information is handled in accordance with our Privacy Policy.

12. Intellectual property

Unless otherwise stated, the website, text, vessel information, photographs, videos, graphics, branding and downloadable materials are owned by or licensed to World Sea Explorers AS.

You may view and download material for legitimate personal, charter-planning, vessel-management or procurement purposes.

You may not reproduce, modify, republish, sell or use the material commercially without prior written permission.

13. External links

The website may link to third-party websites and services.

Links are provided for convenience and do not constitute a guarantee or endorsement of the third party’s availability, accuracy, security or performance.

Third-party websites are governed by their own terms and privacy policies.

14. Website availability and liability

We do not guarantee uninterrupted access to the website or that every function will always be available or error-free.

To the extent permitted by law, WSE is not responsible for losses caused solely by temporary website unavailability, malicious third-party activity, or reliance on general website information where current written confirmation should reasonably have been requested.

Liability relating to an actual charter, voyage, support assignment or other purchased service is governed by the applicable service agreement and mandatory law.

Nothing in these terms excludes or limits liability that cannot legally be excluded or limited.

15. Privacy, cookies and consent settings

World Sea Explorers AS is responsible for personal information collected through stellaoceana.com.

Our Privacy Policy explains what personal information we collect, why we process it, the service providers involved, how long information is retained and your applicable rights.

We use Usercentrics to manage consent for cookies and similar technologies. Non-essential cookies and scripts are not activated unless the visitor has provided the required consent.

You can review, change or withdraw your cookie preferences at any time by opening the privacy settings control displayed on the website. Withdrawing consent does not affect processing that lawfully took place before consent was withdrawn.

16. Changes to these terms

We may update these website terms when the website, services or applicable requirements change.

The latest version will be published on this page with its effective date.

Changes do not retrospectively amend an already confirmed booking or service agreement unless the parties agree otherwise or the change is required by law.

17. Governing law and complaints

These website terms are governed by Norwegian law.

Any dispute will be handled by the competent Norwegian courts, subject to mandatory consumer rights and any alternative dispute-resolution rights that apply.
